MedalTally Pty Ltd Full Terms & Conditions
All quotes and proposals are valid for a period of 30 days from the date detailed on the quote. All quotes and proposals exclude GST.
All quotes and proposals managed by MedalTally Pty Ltd require payment in full or a deposit to be determined by MedalTally Pty Ltd upon acceptance of the quote. It is clearly understood by you, as the client, that work cannot commence until full payment or part thereof has been received by MedalTally Pty Ltd.
MedalTally Pty Ltd reserves the right to bill a “Thereafter” rate per hour for any extra hours over and above an Estimate, which details half or full day rates. This will be detailed on each client Estimate (only if applicable) in this section. Your per hour “Thereafter” rate for this Estimate is $225.00 +GST.
It is clearly understood that all liability and responsibility is accepted by you, the client, when confirming in the affirmative (via email or signature) to artwork pdf confirmation requests or signing hard copy proofs sent by MedalTally Pty Ltd or print supplier/partner.
It is clearly understood that all liability and responsibility is accepted by you, the client, when confirming in the affirmative (via email or signature) to a physical artwork proto-type confirmation request sent by MedalTally Pty Ltd or via MedalTally print supplier/partner. Proto-type samples are sent to you, the client, to assess based on
the general “look and feel” of the artwork created by MedalTally Pty Ltd. It is clearly understood that MedalTally Pty Ltd does not control the materials used in manufacturing proto-types and if they truly reflect the end result.
All images and artwork created by MedalTally Pty Ltd are stored both locally and remotely for a maximum period of 3 years, ensuring that your files, as the client, are safe and secure within this time frame. Access to your files, as the client, is free up to a period of 12 months. Accessing your files, as the client, after a period of 12 months (taken from the date of the fully paid invoice pertaining to the image or artwork), carries a per hour “retrieval fee”. Your per hour “retrieval fee” Estimate will be forward to you, as the client, to be confirmed before any work commences.
By replying in the affirmative to an email from MedalTally Pty Ltd with a Quote or Proposal attached, or signing a MedalTally Pty Ltd Quote or Proposal and returning it to MedalTally Pty Ltd, it is clearly understood that you, as the client, are confirming both the price and the job (as detailed) within the Proposal. You, as the client, are also confirming and agreeing to MedalTally’s Terms & Conditions of trade. It also signals to MedalTally Pty Ltd that the project is to commence forthwith. Please note MedalTally Pty Ltd may also request a Purchase Order if this is a requirement from you, the client, before any work can commence or be invoiced upon completion.
It is understood that MedalTally Pty Ltd may choose to use video footage, final stills (from any shoot) or any artwork created by MedalTally Pty Ltd to promote its business in the form of a hard copy portfolio, website gallery, Instagram, Facebook, Linkedin or Youtube accounts.
Copyright & Intellectual Property of all “Photographic Images” created by MedalTally Pty Ltd remains the property of MedalTally Pty Ltd at all times. MedalTally Pty Ltd allows for the “Usage” of these “Photographic Images” only within context of the original Estimate and project. It is the full responsibility of you, as the client, to request either a new Estimate for updated (i.e. repurposed) “Usage” terms of “Photographic Images”, or to negotiate a full “Photographic Image” buyout fee with MedalTally Pty Ltd. These options are offered at the full discretion of MedalTally Pty Ltd and are only given consideration after full payment has been received by MedalTally Pty Ltd for the original Estimate or project. Any new Estimation’s may also include a “retrieval fee” as detailed above in point 6.
Copyright & Intellectual Property of all “Native Artwork Files” created by MedalTally Pty Ltd remains the property of MedalTally Pty Ltd at all times. “Native Artwork Files” or high-resolution versions thereof (excluding print ready PDF formats) are normally defined as Illustrator, InDesign, Photoshop or any Video or Sound file formats. Access to “Native Artwork Files” can be granted and negotiated under the terms and understanding as a full “Native Artwork File” buyout option with MedalTally Pty Ltd. This option is offered at the full discretion of MedalTally Pty Ltd and is only given consideration after full payment has been received by MedalTally Pty Ltd for the original Estimate or project. Any new Estimation’s may also include a “retrieval fee” as detailed above in point 6.
Copyright & Intellectual Property Rights and Usage terms for all “Photographic Images” & “Native Artwork Files” purchased by MedalTally Pty Ltd on behalf of you, the client, for use in any project remains the full responsibility of you, the client, to seek and adhere to any Copyright & Intellectual Property Rights and Usage terms set down by the third party where the files have originated from i.e. online stock libraries and the like.
All MedalTally Pty Ltd payment terms are 7 days. Invoices that remain unpaid outside of this period will invoke the following:
a) 30 days overdue: an admin fee of AU$175 +GST added to the invoice
b) 60 days overdue: an additional admin fee of AU$175 +GST added to the invoice (2x $175)
c) 90 days plus overdue: a additional admin fee of AU$175 +GST (3x $175) + official letter of demand
